Please read these Terms of Service (“Terms”) carefully before using Eventually (“Service”, “platform”, “we”, “us”, or “our”) operated at eventually.one. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
Eventually is an event management platform that enables individuals and organizations (“Organizers”) to create, publish, and manage events, sell tickets, communicate with attendees, and analyze event performance. Attendees may discover events, register, purchase tickets, receive event updates, and check in. The platform also provides tools for team collaboration, custom registration forms, waitlist management, and communication automation.
Eventually charges 0% platform fee on all ticket sales. Organizers receive 100% of ticket revenue minus Stripe's standard payment processing fees. This policy applies to all plans, including Free, Pro, and Enterprise.
By creating an account or using the Service, you confirm that you are at least 16 years of age (or the minimum age of digital consent in your jurisdiction), have the legal capacity to enter into binding agreements, and accept these Terms and our Privacy Policy in full.
If you are accepting these Terms on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
To use most features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must notify us immediately at hello@eventually.one of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this obligation. We reserve the right to disable any account at our sole discretion if we believe the account has been compromised or is being used in violation of these Terms.
You agree not to impersonate another person or entity, use a false identity, or provide false registration information. Accounts found to contain misleading identity information may be suspended without notice.
Users may create one or more organization accounts (“Organizations”) to manage events as a team. The user who creates an Organization is automatically designated as its “Owner”. Ownership may be transferred to another team member, but an Organization must always have exactly one Owner.
Owners may invite other users to join their Organization with the following roles: Admin, Host, or Staff. Each role carries different permissions within the platform. Owners are responsible for the actions of all team members within their Organization, including compliance with these Terms.
All event data, registration data, and communications created within an Organization are owned by that Organization. If a team member leaves an Organization, they no longer have access to that Organization's data. Eventually does not transfer Organization data between Organizations without explicit owner authorization.
You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit their use of the Service. Specifically, you agree not to:
We reserve the right to investigate and take appropriate action against violations of this section, including suspending or terminating accounts and referring violations to law enforcement.
Organizers are solely responsible for all content they publish on the platform, including event descriptions, images, registration forms, and communications sent to attendees. By publishing an event, you represent and warrant that:
Eventually reserves the right to remove any event content that violates these Terms or that we deem harmful, illegal, or otherwise inappropriate, without prior notice.
Paid tickets are processed through Stripe. Stripe's standard processing fees apply to all transactions. Eventually charges 0% platform fee - we do not take a percentage of ticket sales on any plan.
To receive payouts from ticket sales, Organizers must connect a Stripe account via Stripe Connect. By connecting a Stripe account, you agree to Stripe's Connected Account Agreement and Stripe's Services Agreement. Eventually is not responsible for delays or failures in Stripe payouts.
Refund policies are set by event Organizers at the organization and event level. Organizers may offer full refunds, partial refunds, or no-refund policies. Where a refund policy is stated at the time of purchase, Eventually will process refunds in accordance with that policy via Stripe. Eventually is not responsible for Organizer failure to honor stated refund policies; disputes about event-level refunds must be resolved between attendees and Organizers.
Organizers are responsible for managing chargebacks on their connected Stripe accounts. Eventually will provide reasonable assistance in supplying evidence for legitimate transactions but accepts no liability for chargeback outcomes.
Ticket prices are displayed and charged in the currency selected by the Organizer. Currency conversion, where applicable, is handled by Stripe. Exchange rate fluctuations are not the responsibility of Eventually.
The Free plan is available to all users at no charge. It includes unlimited events, 500 emails/week, and up to 3 team members per Organization. Free plan features may change over time; we will provide notice of material changes.
The Pro plan is available for $9/month per Organization, billed monthly. It includes expanded email limits (5,000/week), up to 5 team members, and additional features such as custom domains. Pro subscriptions are billed through Stripe. You may cancel at any time; your Pro features will remain active until the end of the current billing period.
Enterprise plans are available for organizations with high-volume requirements. Pricing is negotiated individually. Contact us at hello@eventually.one for details.
We reserve the right to change subscription pricing with at least 30 days' prior notice to existing subscribers. If you do not accept a price change, you may cancel your subscription before the new price takes effect.
The Service, including its design, source code, features, and branding (excluding user-generated content), is the exclusive intellectual property of Eventually and its licensors. These Terms do not grant you any ownership rights in the Service. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
You retain all intellectual property rights in content you submit to the Service (event descriptions, images, custom forms, etc.). By submitting content, you grant Eventually a worldwide, non-exclusive, royalty-free license to host, store, display, and transmit that content solely for the purpose of providing and improving the Service. We will not use your content for marketing or advertising without your explicit consent.
If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use that feedback without restriction or compensation to you.
The Service integrates with third-party services including Stripe, Resend, Supabase, MiniMax AI, Twilio, and Vercel. Your use of these integrations is subject to the respective terms of service and privacy policies of those providers. Eventually is not responsible for the availability, accuracy, or conduct of third-party services.
The AI writing assistant is provided as a convenience tool to help draft event content. By using the AI assistant, you agree that:
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.
We do not warrant the accuracy, completeness, or reliability of any content provided by Organizers, including event descriptions, venue information, or ticket availability.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EVENTUALLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, REVENUE, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO EVENTUALLY IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.
Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
You agree to indemnify and hold harmless Eventually, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; (d) any event you organize through the platform; or (e) any dispute between you and an attendee, co-organizer, or other third party.
We aim to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with reasonable advance notice. In the event of unplanned outages, we will make reasonable efforts to restore service promptly. We are not liable for any loss caused by Service downtime or unavailability.
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will provide reasonable advance notice for material changes that affect paying customers. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
You may terminate your account at any time by deleting it from your account settings or contacting us at hello@eventually.one. Termination does not entitle you to a refund of any prepaid subscription fees.
We may suspend or terminate your account immediately, without prior notice, if we determine that you have violated these Terms, engaged in fraudulent activity, or pose a risk to the platform or other users. We will provide notice where legally required. Upon termination, your right to access the Service ceases immediately.
Upon account termination, your data will be handled in accordance with our Privacy Policy and applicable data retention requirements. Sections 9, 13, 14, 18, 19, and 20 of these Terms survive termination.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Eventually is incorporated, without regard to its conflict of law provisions. For users in the European Union, mandatory consumer protection laws in your country of residence also apply.
We encourage you to contact us first at hello@eventually.one to resolve any dispute informally. If a dispute cannot be resolved informally within 30 days, either party may pursue claims in a court of competent jurisdiction.
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not be construed as a waiver of those rights.
These Terms, together with our Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and Eventually regarding the Service and supersede all prior agreements and understandings. These Terms may not be varied except by a written amendment signed by an authorized representative of Eventually.
We may update these Terms from time to time. Material changes will be communicated to registered users via email at least 14 days before they take effect. The updated “Last updated” date will reflect the effective date. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
